These Terms of Use ("Terms") apply to your use of https://www.moxieusc.com (the "Site"), operated by Jero Enterprises Inc., doing business as Moxie Management ("Moxie Management," "we," "us"). By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.

1. Listings are information, not an offer

Listings, availability, rents, fees, deposits, move-in dates, floor plans, amenities, photos, virtual tours, and renderings are for general information only and may change without notice. Some images may be representative or artist renderings and may not show the exact unit. Nothing on the Site is an offer to rent, a promise that a home is available, or a guarantee of a price. A tenancy exists only when you and we sign a written lease, and the signed lease controls over anything on the Site.

2. No guarantee of accuracy

We try to keep the Site current, but we do not guarantee that its content is accurate, complete, or up to date. Please confirm details with us before you rely on them. Neighborhood, school, campus-distance, and safety-patrol information is general and may change.

3. Applications and the tenant portal (AppFolio)

Rental applications, online payments, and the tenant portal are provided by AppFolio, a third party. When you use them, AppFolio's terms and privacy policy apply, in addition to these Terms and your lease. We are not responsible for the availability or operation of third-party services.

4. Acceptable use

You agree not to:

  • use the Site for anything unlawful, fraudulent, or discriminatory;
  • submit false information or impersonate anyone;
  • copy, scrape, or harvest listings or contact details with bots or other automated tools;
  • interfere with the Site's security or operation, or upload malware;
  • re-post our listings or photos elsewhere, including on rental-scam or "for rent by owner" posts.

5. Intellectual property

The Site's content (including text, photos, videos, logos, and design) belongs to Moxie Management or its licensors and is protected by law. You may view and print pages for your own personal, non-commercial housing search. Any other use requires our written permission. "Moxie Management" and related names and logos are our marks.

6. Third-party links

The Site links to third-party sites and services, such as AppFolio, Google Maps, and Google reviews. We don't control them and aren't responsible for their content, policies, or practices.

7. Disclaimer

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT PROMISE THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE. This disclaimer does not limit any rights you have under your lease or under laws that cannot be waived.

8. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, MOXIE MANAGEMENT AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ABOUT THE SITE IS LIMITED TO $100. This section applies only to your use of the Site. It does not apply to claims under a lease or to liability that cannot be limited by law.

9. Indemnity

You agree to defend and indemnify Moxie Management against claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these Terms.

10. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute about the Site will be heard only in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.

11. Changes

We may update these Terms. The updated Terms apply once posted, with a new effective date. If you keep using the Site, you accept the changes.
